Applicability of the terms of service

I. Eligibility and Age Requirements

Age Restriction

Fallen Evolution contains mature themes, including sexual and drug references. You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction, to create an account and agree to these Terms of Service. By accessing Fallen Evolution, you represent and warrant that you meet this age requirement.

Minor Access (Users Under 18)

Users under the age of eighteen (18) or the age of legal majority in their jurisdiction may only use Fallen Evolution with the prior express consent and direct involvement of their parent or legal guardian.

Parent/Guardian Acceptance

By allowing a minor to use Fallen Evolution, the parent or legal guardian (1) agrees to these Terms of Service on the minor's behalf, (2) fully accepts responsibility for the minor's compliance with all rules and obligations defined herein, and (3) agrees to the terms of Indemnification below.

II. Information Accuracy and Consequences

Accuracy of Information

You agree to provide accurate and truthful information regarding your age. Providing false information is a material violation of these Terms of Service and may result in immediate account termination.

Consequences of Unauthorized Underage Use

Any use of Fallen Evolution by a user under the age of 18 without prior express parental consent is unauthorized. Fallen Evolution reserves the right to suspend or terminate any account immediately and without notice based on our sole determination that a user does not meet eligibility requirements.

III. Parental Responsibility and Indemnification

Parental Responsibility

Parents and legal guardians are fully responsible for the security of their devices and accounts. You are responsible for monitoring your children's online activity and ensuring they adhere to these Terms of Service, including all in-game conduct rules. If you believe your child has accessed Fallen Evolution in violation of these Terms without your consent, please contact us immediately.

Indemnification

To the maximum extent permitted by law, you agree to indemnify and hold Fallen Evolution harmless from any and all claims, liabilities, damages, and expenses (including legal fees) arising from any use of Fallen Evolution by a minor associated with your household, account, or device, whether or not you were aware of such use.

Your account and license

License Grant and Use

To access many features of Fallen Evolution, you must create an account and download the client software. We grant valid account holders a non-exclusive, non-transferable, personal, limited license, which may be revoked at any time, for the period of membership. This license permits you to use Fallen Evolution, download and use our client software, and connect to our servers solely in accordance with these Terms of Service.

Fallen Evolution and any associated software are **licensed, not sold**. Your license confers no title or ownership to Fallen Evolution or the software.

Username and Conduct Restrictions

You must not choose a username that:

• Infringes the rights of any third party or impersonates Fallen Evolution staff or other users.
• Is deliberately confusing, offensive, racist, obscene, hurtful, unlawful, or otherwise inappropriate.
• Breaches the specific username requirements detailed on our site or in our Rules.

We reserve the right, in our sole discretion, to change any username for any reason or take any other appropriate action.

Account Security and Responsibility

You agree to keep your password safe at all times and not disclose it to any other person. You are **responsible for the activities of all persons** who use your password to gain access to your account.

To maintain password safety, you must keep your computer free of viruses and other malicious code (including Trojans) and use your password in accordance with the security requirements specified on our site and our Rules.

Compromised Account Procedure

If you believe that someone has stolen your password or otherwise gained unauthorized access to your account, you must immediately submit an **Account Recovery request** via the Fallen Evolution game client and follow our password guidance procedures.

User Content Must:

• • be accurate, complete, uploaded or sent in good faith and compliant with all applicable laws, regulations and codes of conduct; and
• • only be uploaded or sent if you own the rights in such content, have appropriate permission from the rights owner, or are otherwise authorized by law.

User Content Must Not:

• • be obscene, hateful, inflammatory, threatening, harassing, sexually explicit or deceptive or fraudulent in anyway;
• • promote violence or discrimination, promote or endorse any illegal activity or otherwise be objectionable;
• • be defamatory or an invasion of an individual's right to privacy;
• • infringe the intellectual property or other rights of any third party, including copyrights, trade marks, database rights, any rights of confidentiality or any similar rights;
• • attempt to or purport to impersonate any person or misrepresent your identity, affiliation or connection to any other person;
• • include hyperlinks or connections to third party websites;
• • contain viruses, Trojans, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software, hardware or network;
• • reveal details that enable you or anyone else to be identified or contacted outside of the game (e.g. last name, postal/email address or telephone number);
• • have any commercial purpose; and
• • involve junk mail, spam, pyramid selling or similar schemes.

I. User Code of Conduct

This User Code of Conduct applies to your interactions within the Service and on any official Fallen Evolution platforms (e.g., forums, Discord servers).

And, it extends to your conduct outside the Service (e.g., on social media, private messaging, or other external platforms) when such conduct relates to, impacts, or involves Fallen Evolution, its community, its staff, or other players, or otherwise undermines the integrity or reputation of the Service.

By using the Service, you agree to adhere to the following standards of conduct and to foster a positive and respectful community environment. You must not engage in any activity that is harmful, disruptive, or manipulative to the Service, Fallen Evolution, its staff, or other players.

The following behaviours are strictly prohibited:

II. Harassment and Bullying:
• Engaging in any form of harassment, bullying, stalking, intimidation, or hateful conduct towards other players or Fallen Evolution staff, whether within the game, via private messages, or on public forums and social media related to the Service.
III. Dishonest, Deceptive, or Malicious Conduct:
• Engaging in any conduct that is dishonest, deceptive, fraudulent, or malicious, or that demonstrates a lack of good faith in interactions with Fallen Evolution, its staff, or other players. This includes, but is not limited to, intentionally misleading others, misrepresenting your identity or intentions, or acting with the primary purpose of causing harm or disruption.
IV. Monitoring, Stalking, and Privacy Violations:
• Using the Service or any related platforms to monitor, stalk, or gather personal information about other users or Fallen Evolution staff without their express consent, or in any manner that violates their privacy or the spirit of respectful interaction. This includes, but is not limited to, unauthorized data collection, tracking, or surveillance.
V. Disruptive or Abusive Behaviour:
Participating in or encouraging activities that are disruptive to the normal operation of the Service or the enjoyment of other players, including but not limited to:

• Creating or promoting "drama" or public spectacle concerning moderation decisions, bans, or other disputes.
• Deliberately misrepresenting facts or spreading false information about the Service, its staff, or its community.
• Spamming, griefing, trolling or other actions intended solely to annoy or inconvenience others.
VI. Manipulation and Bribery:
• Attempting to bribe, coerce, extort, or unduly influence Fallen Evolution, its staff, or its representatives regarding any aspect of the Service, including but not limited to moderation decisions, account status, game features, or access to the Service.
• Offering any form of payment, gifts, or incentives with the intent to bypass rules, gain unfair advantage, or influence outcomes outside of legitimate, advertised transactions.
VII. Slander, Misrepresentation, and Defamation:
• Any attempt to slander, libel, or defame the Service, its staff members, or its partners through false statements of fact, misrepresentation, or spreading unsubstantiated claims. This includes, but is not limited to, intentionally fabricating stories or details about the Service's operations, policies, or team.
VIII. Abuse of Public Channels and Review Systems:
• Writing or soliciting false, misleading, or excessively negative reviews or posts on official or public platforms (e.g., Steam, app stores, dedicated review sites, or social media) with the primary intent of damaging the game's commercial interests or reputation, rather than providing good-faith criticism.
IX. Malicious Trolling and Targeted Attacks:
• Utilizing platforms, including social media, forums, or review sites, to troll the game or its staff, or to launch coordinated, sustained, or malicious attacks on the game's reputation, community perception, or financial standing.
X. Misuse of Official Branding:
• Unauthorized use of the Fallen Evolution logo, name, or other official branding in a manner that falsely implies endorsement, or in connection with content that violates this Code of Conduct or otherwise brings disrepute to the brand.
XI. Revealing Confidential Information:
• Unauthorized sharing of non-public information about Fallen Evolution, its staff, its business practices, or unreleased content, especially when such sharing is done with the intent to cause harm, confusion, or market disruption.
XII. Exploitation and Cheating:
• Exploiting bugs, glitches, or design flaws to gain an unfair advantage.
• Using unauthorized third-party software, scripts, or tools (including bots, macros, or cheats) to automate actions, modify the game, or gain an unfair advantage.
• Sharing, promoting, or distributing methods for cheating or exploiting the Service.
XIII. Theft of In-Game Assets:
• Dishonestly acquiring, transferring, using, or disposing of in-game items, virtual currency, or other digital assets (including those associated with other players' accounts) without authorization or by exploiting system vulnerabilities. This includes, but is not limited to, actions commonly referred to as "hacking," "phishing," "scamming," or "stealing" in the context of digital property within the Service.


XIV. Intellectual Property Infringement:
• Copying, distributing, modifying, reverse-engineering, or creating derivative works from any part of the Service, its content, code, artwork, or other intellectual property belonging to Fallen Evolution or its licensors, without express written permission. This also includes the unauthorized reproduction or distribution of any user-generated content that infringes on the intellectual property rights of others.


XV. Impersonation and Misrepresentation:
• Impersonating Fallen Evolution staff, other players, or any other person or entity, or otherwise misrepresenting your identity or affiliation.


XVI. Account Sharing/Trading:
• Selling, trading, sharing, or transferring accounts or any account-related assets (including virtual currency or items) outside of the legitimate means provided by Fallen Evolution.


XVII. Unauthorised Commercial Activity:
• Using the Service for any unauthorized commercial purposes, including advertising or promoting third-party products, services, or websites, without express written permission from Fallen Evolution.

Fallen Evolution Stopping your account

We reserve the right, acting reasonably, to take immediate action if we determine that certain conditions have been met. If we consider that:

• Our Terms of Service have or may have been breached;
• There has been fraudulent, unlawful, or abusive activity on the account; or
• It is necessary in order to prevent or stop any harm or damage to us, to Fallen Evolution, to other players, or the general public,

Then, we may at any time take any of the following actions:

1. Suspend or Terminate ("Stop") any or all accounts for Fallen Evolution;
2. Restrict access to any content-uploading or other feature of our service; and/or;
3. Restrict access to or delete virtual currency or anything acquired by means of virtual currency.

These actions may result in loss of real money paid in prohibited transactions (such as account trading). If we take any of the above actions, you may have a right of appeal.

Refund policy

We are happy to review requests for refunds on a case-by-case basis. However, refunds are not always possible for many reasons.

Unless required by law, we will not refund any amounts paid in relation to subscriptions, in-game activities, virtual items, or virtual currency when:

• You have been the victim of in-game scamming, as there are many warnings about avoiding this on Fallen Evolution (however, we will do everything we reasonably can to assist you to recover your accounts).
• You have been banned from Fallen Evolution for violating these Terms of Service, any Rules of Fallen Evolution, or the user content policy.
• Elevations stops offering Fallen Evolution, or you decide to cancel your subscription or account.

If, after reviewing the above conditions, you wish to request that we consider a refund, please contact Fallen Evolution Support for assistance, providing as much information as possible. Please note, refunds are given at the sole discretion of Fallen Evolution.

Reverse Engineering and Integrity of Service.

Section 4.2.

• Users are strictly prohibited from attempting to decompile, disassemble, reverse-engineer, perform deep analysis or otherwise derive the source code, underlying algorithms, or internal data structures of the Fallen Evolution client, server software, or associated data files. Any attempt to modify, bypass, or circumvent security measures, including but not limited to custom networking protocols and authentication schemas, is a material breach of this Agreement and will result in the immediate termination of the User's account and access to the Service.
